The Terms & Conditions – TUFA Legs 11 Campaign

Introduction

  1. These are the terms and conditions set by The Umbrella Foundation Australia (TUFA) – ABN:  – 18621117566 in relation to the fundraising campaign known as Legs 11, scheduled to run in November 2021.
  2. The event will raise funds for TUFA from the public. TUFA is a registered charity in Australia.
  3. The Umbrella Foundation Australia (TUFA) was founded in 2013 and is a small registered charity in Australia supporting trafficked & vulnerable children, vulnerable women and their communities in Nepal. The activities of TUFA in Australia primarily involve fundraising, advocacy and community awareness building.

Who Do The Terms and Conditions Apply to?

 The T&C apply to anyone accessing the https://umbrellafoundationfundraising.org and the https://umbrellaaustralia.org websites for any reason, including leaving a comment on the website, making a donation, becoming a member or registering a profile.

  1. The continued use of the websites indicates the user agrees with the T&C (as amended from time to time)
  2. Many T&C are also applicable to anyone commenting on social media posts, stories and reels on TUFA accounts, in addition to the T&C and account controls TUFA is granted by the respective social media site as the account owner.

Who Can Participate in The Legs 11 Campaign

 Anyone worldwide – inclusivity is a TUFA principle – can participate in the Legs 11 Campaign, subject to some age, risk and on-going conduct limitations.

 Age to participate in The Legs 11 Campaign

  1. Team leaders for team participation must be at least 18 years of age. Participants 16 years of age or less can participate in team events with the consent of both (1) their parent or guardian, and (2) the team leader.
  2. It is the responsibility of the team leader to consider the appropriateness of the team challenge for people aged 16 years and under (a child) and consider what information and images should be posted by the team.
  3. People 16 years of age or less can participate as an individual with the consent of their parent or legal guardian.
  4. In all cases TUFA may ask for proof that consent has been given at any time.
  5. Some of the things a team leader or participant should consider is whether the challenge activity is age appropriate for the participants, the amount and type of personal information posted, whether identifying information is posted (for example, addresses, school locations, social media accounts, geolocation through photographs) and whether other children are in any photos.

Risk and Appropriateness of a Legs 11 Campaign Challenge

 All participants in a Legs 11 Campaign Challenge participate at their own risk.

  1. The responsibility for assessing whether a challenge activity poses an acceptable risk to the participants is the responsibility of the team leaders and individual participants. It is not the responsibility of TUFA. TUFA will not have access to sufficient information to effectively assess the relevant risk.
  2. Some of the things a team leader or participant should consider in the case of physical challenges (e.g hiking, running, cycling, swimming) is the health and fitness of participants, medical conditions, the temperature and humidity at the time, the time of day, the terrain, the suitability of the equipment, the targets set, having maps and navigation equipment, support and aid arrangements.

 Appropriateness of a Challenge and the Conduct of Participants in Relation to the Objects and Principles of TUFA

  1. TUFA was founded to support trafficked & vulnerable children and vulnerable women, families and their communities in Nepal.
  2. All Legs 11 Campaign challenge activities, and the conduct of the team leaders and all participants should be mindful of TUFAs objects and principles when considering appropriateness and their ongoing conduct on the TUFA websites and social media accounts, and on other sites and accounts if the content is about TUFA and the Legs 11 Campaign.
  3. As examples, TUFA does not support racist or anti-neaplese content, content that is not supportive of or is anti-women, body shaming or anti-body positivity messages, commentary about TUFAs project partners and programs in Nepal that is not factual or is politically or religiously motivated.

TUFA may Suspend or Remove a Team, Individual and challenge from the Legs 11 Campaign and Access to any TUFA Site or Platform

  1. Notwithstanding the responsibility the team leaders and individual participants have to assess the risk and suitability of the Legs 11 challenge activity and monitor and moderate profiles, comments and images for appropriateness, TUFA may suspend or remove a challenge from the campaign if it considers it is not in the interests of TUFA for the challenge to continue.
  2. The decision to suspend and/or remove a team, participant or challenge from the campaign is entirely at TUFAs discretion. TUFA can enforce its rights at any time, including after the campaign has ‘ended’.

To Avoid Fraud and Provide Security for Donations

 It is important that potential donors know they are making a secure donation that is actually received by TUFA.

  1. To reduce the risk of potential fraud by others, participants are asked to use the materials provided for promotion by TUFA and not to use the TUFA name, logos and images to prepare their own materials that may be less secure.
  2. No other person other than registered participants may use the TUFA Legs 11 campaign materials provided or any other physical or digital material owned by TUFA (not limited to names, logos, images and posts)
  3. Participants cannot accept cash or other donations on behalf of TUFA – all donations must be made via the TUFA websites and payment gateways.

 Other Requirements

 The TUFAs services must not be used to harass or bully other people.

  1. The TUFA services must not be used to spam or to promote products or services that are not TUFA products and services
  2. The TUFA services are not a place for political or religious discussion unless TUFA clearly invites political commentary on a post or article.
